LMIA for Work Permit

1. Employer Application:

At the beginning of the LMIA process, the employer needs to apply to the ESDC. This application must include detailed information regarding the job position, such as job requirements, job duties, efforts, and wages necessary for recruiting workers.

2. Recruitment Efforts: 

As part of the LMIA for work permit in Canada, employers need to show that they have tried to recruit Canadian citizens or permanent residents for this particular job position. Job vacancy advertisements through various channels may act as proof of your efforts regarding the recruitment activity. 

3. Assessment by ESDC: 

ESDC analyses the LMIA application to decide whether there is a need to hire a foreign worker for the position. By opening the job to the foreign nationals there will be a positive or neutral impact on the Canadian labor market. Factors considered in the assessment include the employer’s recruitment efforts, the wages offered, the job duties, and the potential benefits of hiring a foreign worker.

4.Labor Market Impact Assessment Decision: 

Following a review of the application, ESDC will issue a decision on whether to permit or refuse the LMIA. The employer receives a positive LMIA when it is approved, allowing them to hire foreign professionals for the particular job. In case of a refusal, the employer is expected to get a letter with an explanation. Processing times for LMIA application can vary.

5. Job Offer to Foreign Worker: 

An employer with a positive LMIA can send a formal job offer to the selected foreign worker. The job offer must include details such as the job title, duties, wages, and other terms and conditions of employment.

6. Work Permit Application:

Once an LMIA application has been approved, the employer should give a copy of the approved letter to the temporary foreign worker (TFW). The TFW will then make an application for IRCC to receive a work permit.
