Overview of Canada’s Commissioners of Oath

Canada’s Commissioners of Oath are a group of people who can take an oath when an individual signs an affidavit or statutory declaration. Commissioners for Taking Affidavits Act authorizes Commissioner of Oath. However, they are not responsible for the declared content through the affidavit.

Your Responsibility
  • While signing a legal document that requires you to take an oath, it is your sole responsibility to ensure that the content accurately represents the truth. In this case, you can be recognized as the ‘deponent’. 
  • As a deponent, you need to understand the documents in detail and it must be attested by the notary public. Swearing oath means attesting to the information in the affidavits. 
Responsibility of Commissioners of Oath
  • In all the Canadian provinces, Canada’s Commissioners of Oath have to administer a declaration by law. Therefore, the deponent has to be present physically in front of the commissioner of oath. 
  • Before document signing, the commissioner of oath must be assured of the deponent’s identity. Signature comparison with other documents such as provincial health insurance card, driver’s licence and passport becomes essential.
